President Pro-Tem Gohl called the meeting to order at 6:40 p.m.  Roll Call.

President Pro-Tem Gohl ordered recess until the arrival of President Abboud.

 

*Recess ended at 6:45 p.m. with the arrival of President Abboud.

 

ADMINISTRATION – Robert G. Abboud

 

President Abboud explained that the purpose of the meeting was to discuss changing counsel in the Dallas-Christopher Ltd. vs. Village of Barrington Hills (hereinafter referred to Duda II) deannexation litigation matter from the Burke, Warren, MacKay & Serritella, Ltd. law firm to the Childress, Duffy, Goldblatt, Ltd. law firm (hereinafter CDG) and the Matuszewich, Kelly & McKeever, Ltd. law firm (hereinafter MKM). Attorneys Brandys, Eshoo and Mammel represented CDG, a Chicago law firm, and Attorneys Kelly and Matuszewich represented MKM, a McHenry County law firm.

 

The representatives of CDG and MKM described their qualifications for the case and fielded several questions from the Trustees on topics including the firms’ depth of expertise in municipal law, potentials for conflict of interest, hourly rates, and willingness to pursue settlement in parallel to litigation efforts.

 

Trustee Smithe motioned to adjourn the Public Session to Executive Session with the guest attorneys present to discuss legal strategy for the Duda II deannexation case at 7:58 p.m.  Trustee McKevitt seconded.  Roll Call.

EXECUTIVE SESSION

 

PUBLIC SESSION

 

President Abboud called the Public Session to order at 8:56 p.m.

 

Authorization to Negotiate – Trustee Horne motioned to endorse Trustees Knoop and Schueppert to enter into a series of meetings with Mr. Duda and Mr. James or their representatives, for the purpose of negotiation. Trustee McKevitt seconded.  All present said aye.

Authorization to CDG and MKM for Duda II Litigation – Trustee Smithe motioned to confirm the Village President’s engagement of CDG and MKM law firms as co-counsel representing the Village in the Duda II litigation matter.  Trustee McKevitt seconded.  All present said aye.

Authorization of CDG for Negotiations with Hoffman Estates – Trustee Smithe motioned to confirm the Village President’s engagement of CDG law firm as special co-counsel representing the Village in negotiations with Hoffman Estates.  Trustee Schueppert seconded.  All present said aye, with one voting nay.

Trustee Horne motioned to adjourn the Public Session at 9:07 p.m.  Trustee McKevitt seconded.  All present said aye.
