1.3 VILLAGE OF BARRINGTON HILLS Minutes of the Special Meeting of September 6, 2002 President Kempe called the meeting to order at 7:05 p.m. Roll Call. Present Absent James A. Sapp, Trustee Thomas Hayward, Attorney Robert Kosin, Director of Administration Stephen Carponelli, Attorney Douglas Wambach*, Village Attorney Thomas Mitchell, Resident Joanne Mitchell, Resident *Telephone Conference Mitchell Conservation Easement – President Kempe began the meeting by reviewing the documents presented on behalf of the Mitchells for the Village to accept a conservation easement on their property at 19 Brinker Road. Douglas Wambach reported that Michael Lukich, Village Engineer, had visited the property and observed the completion of the items he had requested to occur by September 5, 2002. A letter to that effect may be produced. The conservation easement document was acceptable to all concerned and signed by Mr. and Mrs. Mitchell. The enabling resolution was proposed to be amended to include a reference to the penalty provisions of the Zoning Ordinance. The exhibits to the easement were individually reviewed. Exhibits B and C will be drawn at a scale to show the Mitchell improvement and the location of the conservation agreement on the property. Exhibit D is the landscape plan submitted by the Mitchells which Attorney Hayward used to present an alternative proposal on behalf of the Bischofs and McTerrans. The Mitchells asked the Board to select the plan to be used as the exhibit. Special Board Meeting September 6, 2002 – page 2 President Kempe proposed a committee of Trustees Sapp and Horne and such other person of their choice to select the landscaping plan for Exhibit D. Trustee Sapp proposed Michael Schmechtig form the Plan Commission as the third member. President Kempe proposed the committee complete its work by Friday, September 20, 2002. In the alternative of awaiting a decision by the Committee, the parties agreed to accept the decision of the Committee. Exhibit E is proposed as the lighting plan being the standards previously considered by the Village for all residences. Trustee Sapp motioned and Trustee Abboud seconded that the Village accept the Mitchell conservation easement subject to (1) landscape plan as may be created by a committee of Horne, Sapp, and Schmechtig; (2) reference of the penalty provisions of section 5-10-9 in the adopting resolution; (3) revised Exhibits B and C as may be acceptable to the Village Attorney and Engineer.
